Minutes of Meeting— July 28, 2011
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts. At 7:30 p.m., Lawrence Norris called the meeting to order.
Present: Lawrence Norris, Dorothy Risser, Todd Pietrasiak, Christopher Tibbals, Patrick Manzo, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.
Petition 1023: 201 Manning Street, Variances
Present were: David Harris, OMR, Project Manager
Jared Gentilucci, Nitche Engineering, Civil Engineer
Mr. Norris explained that at its last meeting with the applicant there was a concern for the number of parking spaces that were being proposed for the new middle school. The Board asked that the applicant furnish them with a letter from Principal Daniels (JFK Principal) stating that he agreed the number of proposed spaces would be sufficient.
Mr. Norris noted for the record two letters received by the Board. The first letter was from Principal Daniels and Superintendent Kevin Lyons dated July 19, 2011. The other letter was from OMR Architects; in it David Harris supplied the Board with a detailed explanation of the parking needs.
As this was the only outstanding issue the Board had no further issues.
Dorothy Risser, seconded by Todd Petrasiak, made a motion to go into deliberative session.
Vote: 5-0-0, Unanimous
Lawrence Norris, seconded by Dorothy Risser, moved to grant Variances under the following:
Section 7.1.4.2 to all allow for a reduction of 24’ width for the parking access/egress where two way traffic is allowed, and;
Section 7.1.4.3 to allow that wheel stops not be used at the head of each parking space, and;
Section 7.1.4.5 to allow for 24’ wide interior drive aisles for two way traffic and a
15’ turning radius at the parking lot access points, and;
Section 7.1.4.6 to waive the requirement of a maximum profile gradient of 3% for a minimum distance of 50 feet from an intersecting drive, and;
Section 7.1.5.12 to allow for 137 parking spaces instead of the required 396, and;
Section 7.1.6.2 to allow for a turning radii at the entrance of the loading dock area of 25’ based on the following findings:
- The Petitioner has standing to bring the Petition, and;
- The subject property is located in the SA-8 District, and;
- That owing to circumstances relating to the soil conditions, shape and topography affect this land but not generally affecting the rest of the zoning district, and;
- A literal enforcement of the zoning by-law would involve substantial hardship to the developer, and;
- Relief may be granted without substantial detriment to the public good and without substantially derogating from the intent and purpose of the by-law.
Vote: 5-0-0, Unanimous
Dorothy Risser, seconded by Todd Petrasiak, made a motion to come out of deliberative session.
